Electronic Signature
Regulation (EU) No 910/2014 of 23 July 2014 on electronic identification and trust services in electronic transactions in the internal market and repealing Directive 1999/93/ECIt defines the different types of electronic signature in its Article 3:
- “Electronic signature”, data in electronic format attached to other electronic data or logically associated with it that is used by the signatory to sign.
- “Advanced electronic signature”the electronic signature that meets the requirements of Article 26.
- “Qualified electronic signature”, an advanced electronic signature which is created by a qualified electronic signature creation device and which is based on a qualified electronic signature certificate.
Likewise, the requirements of an advanced electronic signature are defined in its article 26:
- Be linked to the signatory in a unique way.
- Allow the identification of the signatory.
- Have been created using data of creation of the electronic signature that the signer can use, with a high level of confidence, under his exclusive control
- Be linked to the data signed by the same in such a way that any subsequent modification thereof is detectable.
Therefore, the electronic signature will allow the sender and the receiver of the information or content to be identified with the certainty that they are the only ones who interact. In this way it is guaranteed that the content is not altered, has not been intercepted during the communication and that both cannot repudiate the previously received and accepted information.
