Regulation (EU) No 910/2014 of 23 July 2014 on electronic identification and trust services in electronic transactions in the internal market and repealing Directive 1999/93/ECIt defines the different types of electronic signature in its Article 3:

  1. “Electronic signature”, data in electronic format attached to other electronic data or logically associated with them that the signer uses to sign.
  2. “Advanced electronic signature”, the electronic signature meeting the requirements referred to in Article 26.
  3. “Qualified electronic signature”, an advanced electronic signature which is created by a qualified electronic signature creation device and which is based on a qualified electronic signature certificate.

In addition, the requirements of advanced electronic signatures are defined in article 26:

  • Be linked to the signatory in a unique way.
  • Allow the identification of the signer.
  • Have been created using electronic signature creation data that the signer can use, with a high level of confidence, under his/her exclusive control
  • Be linked to the data signed by the same in such a way that any further modification of the same is detectable.

Therefore, the electronic signature will allow the sender and receiver of the information or content to identify themselves with the certainty that they are the only ones who interact. In this way it is guaranteed that the content is not altered, has not been intercepted during the communication and that both cannot repudiate the information previously received and accepted.
